Nurse Next Door believes that seniors can stay at home, and we believe in helping seniors do what they love to do again through our Happier Aging program. We are Canada's leading home care brand, and we are looking to add amazing entrepreneurs to our existing markets.
1. I am referring an individual to Nurse Next Door Home Healthcare Services, Canada Inc. ("Nurse Next Door") as a potential candidate (the “Potential Candidate”).
2. I am an arms-length referral source from the Potential Candidate (i.e. the Potential Candidate is not immediate family or a business partner)
3. I acknowledge and agree that I am not an agent acting on behalf of Nurse Next Door and I have not represented, or in any way made the Potential Candidate believe that I am acting on behalf of Nurse Next Door. I acknowledge and agree that I have no authority to make any representations on behalf on Nurse Next Door.
4. I have not, and I agree that I will not, make any representations or warranties (written or orally) about Nurse Next Door or the operation of a Nurse Next Door franchise to the Potential Candidate concerning the actual revenues, profits or operation costs of a Nurse Next Door franchised business or of the likelihood of the Potential Candidate being successful as a Nurse Next Door franchisee.
5. I am aware that the referral fee is only payable for referrals for new potential franchisee candidates to Nurse Next Door that are awarded a franchise by Nurse Next Door and open and operate a Nurse Next Door franchised business within Canada.
6. I am aware that the referral fee is only payable for the first new territory within Canada that the Potential Candidate is awarded and accepts. Any additional territories that the Potential Candidate may purchase do not qualify for any additional referral fees. Any resale of any existing territory does not qualify for a referral fee.
7. I acknowledge that eligibility for the referral fee shall expire six (6) months from the date of this referral. For greater clarity, if the Potential Candidate has not been awarded and accepted a Nurse Next Door franchised business within six (6) months from the date of this referral, I will not be eligible for a referral fee or any other bonus or reimbursement.
8. I confirm that to complete my eligibility for the referral fee I will need to complete an additional declaration confirming that I have fully complied with the requirements of the referral program. This additional declaration will be submitted once the Potential Candidate has been awarded and accepts to operate a Nurse Next Door franchised business.
9. I understand and agree that if I am eligible to receive a referral fee, the referral is a total of $10,000, payable in two advances. The first advance of $5,000 will be payable upon the franchise agreements being fully executed by the Applicant and Nurse Next Door. The second advance of $5,000 will be payable upon the Potential Candidate's franchised business billing $100,000 in gross sales. I understand and agree that I am solely responsible for all taxes due and payable on the referral fee.
10. I understand and agree that Nurse Next Door has the sole discretion to amend, cancel or replace this Potential Candidate referral fee program at any time at its sole discretion and I agree not to bring any claim and will hold Nurse Next Door harmless with respect to the Potential Candidate referral fee program. Nurse Next Door may create additional rules and regulations with respect to the referral fee program and I agree to be bound by and abide by any such rules and regulations.
11. I acknowledge and represent that I have a real and substantial connection to the Potential Candidate and I acknowledge and agree that Nurse Next Door may determine in its sole discretion modify the rules and eligibility of potential candidates and individuals seeking referral fees under this program.
12. By submitting this form, I am acknowledging and declaring that I am making representations that Nurse Next Door will be relying upon. I acknowledge and agree that making false statements will invalidate my eligibility for the referral fee program and I may be held liable with respect to any misrepresentations made by me.
